1. Who provides Kolbaba
Kolbaba is provided by Jakub Šťastný, a sole trader (OSVČ) registered in the Czech Republic, IČO 08542953, with registered place of business at Rečkova 1597/6, 130 00 Praha 3 – Žižkov, Czech Republic (“we”, “us”). You can reach us at hello@kolbaba.app.
These Terms are an agreement between you and us. You accept them when you create a Kolbaba account. How we handle personal data is explained in our Privacy Policy.
2. What Kolbaba is
Kolbaba is an email client. It connects to your existing mailboxes (Gmail, Seznam, your own domain and other IMAP/SMTP mailboxes) and lets you read, organise and send mail. You use it at app.kolbaba.app in a browser or install it on your home screen; it can send push notifications. It also has an MCP server through which AI agents you connect can work with your mail.
Kolbaba is a client, not a mailbox. Your mail lives with your mailbox provider; Kolbaba keeps a copy so it’s fast on every device.
3. Early access
- Kolbaba is in early access and still under active development. We may add, change or remove features, and sign-up may be by invitation only.
- There will be bugs. We don’t guarantee any particular availability or uptime, and there may be outages or maintenance breaks.
- We’ll try to tell you about significant changes in advance.
- Support is by email at hello@kolbaba.app. We answer as soon as we reasonably can.
4. Price
Kolbaba is free of charge during early access.
We may introduce a paid plan later. If we do, we’ll tell you at least 30 days in advance, including the price and what it includes. We won’t charge you anything unless you explicitly agree to it, for example by choosing a plan and entering your payment details. If you don’t want to pay, you can stop using Kolbaba and have your account deleted.
5. Your account
- You must be at least 16 years old to use Kolbaba.
- Use an email address that is yours and keep your details accurate.
- Keep your sign-in secure: protect the devices that hold your passkeys and the Google account you sign in with. Don’t share your account.
- You are responsible for what happens in your account, including actions of AI agents you connect.
- If you suspect someone else has access to your account, let us know at hello@kolbaba.app right away.
6. Your mailboxes and content
- Your content stays yours. Your mail, drafts, signatures and settings belong to you (or whoever holds the rights to them).
- You give us a non-exclusive, free permission to store, process, transmit and display your content only to the extent needed to operate Kolbaba for you: syncing, showing, searching, sending, delivering notifications and passing data to AI agents you connect. This permission ends when you delete the content or your account (copies in backups expire as described in the Privacy Policy).
- Only connect mailboxes you are allowed to access. The terms of your mailbox provider (for example Google or Seznam) continue to apply to your mailbox.
- Actions happen in your real mailbox. When you archive, mark as read, pin, move to Spam or Trash, or send in Kolbaba, the change is made at your mailbox provider and you’ll see it in other mail apps too. Scheduled emails are sent from your mailbox at the scheduled time.
- Kolbaba is not a backup. The first import covers the last 90 days; older mail stays only with your provider.
7. Acceptable use
Please don’t use Kolbaba to:
- send spam or bulk unsolicited messages;
- do anything illegal, or send content that is illegal or infringes the rights of others;
- spread malware, phishing or other harmful content;
- overload, disrupt or abuse the service, including automated use beyond what a normal email client does;
- try to break or bypass our security, or access other people’s accounts or data;
- secretly monitor people, including through read tracking (section 8).
You must comply with the laws that apply to you, including the laws on electronic communications, marketing and data protection.
8. Read tracking
Read tracking is off by default and you turn it on for each email. If you use it, you decide to process the recipients’ data and we do so on your behalf. You are responsible for having a legal basis for it and for informing recipients where the law requires it (for example when you use it for work or marketing). Respect the privacy of the people you write to. An open is a hint, not proof that someone read your email.
9. AI agents
- You decide whether to connect an AI agent, which mailboxes to share with it and which permission level to give it (Read only, Organize & draft or Full access).
- The agent acts on your behalf. You are responsible for what it does with the access you gave it, including emails it sends in your name.
- Watch out for prompt injection. An incoming email can contain hidden instructions aimed at AI agents, for example asking it to forward your mail or send a message. An agent may follow them even though you never asked it to.
- Give agents only the access they need. We recommend Read only or Organize & draft; use Full access only when you really need an agent to send email, and check what it does.
- AI activity shows everything agents did. Many actions can be undone there, and a sent or scheduled email can be cancelled while it still waits in the queue. Once an email has left, it can’t be recalled.
- The agent’s provider processes what the agent receives under its own terms; we are not responsible for the agent, its answers or its provider.
10. Third-party services
Kolbaba depends on services we don’t control: your mailbox providers, Google, browser push services, AI agent providers and our hosting providers. Their terms apply to your use of them. If they have an outage, change or restrict their services, or revoke access (for example to the Gmail API), parts of Kolbaba may stop working. We’ll do what we reasonably can, but we are not responsible for these services.
11. Liability
- We build Kolbaba carefully, but during early access it is provided “as is” and “as available”, to the extent permitted by law. We don’t promise it will be uninterrupted or error-free, or that every message will sync or be sent on time.
- We are not responsible for damage caused by your mailbox provider, by AI agents you connected or their providers, by other third-party services, or by your own breach of these Terms. To the extent the law allows, we are not liable for indirect damage such as lost profit.
- Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, in particular for harm to life or health or to a person’s natural rights, for damage caused intentionally or through gross negligence, or your mandatory rights as a consumer.
12. Ending the agreement
- You can stop using Kolbaba at any time. You can disconnect a mailbox in Settings and have your account deleted by writing to hello@kolbaba.app. We then delete your data as described in the Privacy Policy.
- We may suspend or close your account if you seriously or repeatedly breach these Terms, if the law requires it or if it is necessary to protect the service or other people. Unless the law or an urgent risk prevents it, we’ll tell you why and give you a chance to put things right.
- If we decide to shut Kolbaba down, we’ll tell you at least 30 days in advance and give you a way to keep the data that exists only in Kolbaba, such as drafts and signatures. Your mail stays in your mailboxes either way.
13. Changes to these Terms
We may update these Terms, for example when Kolbaba changes or the law requires it. We’ll tell you about significant changes in the app or by email at least 30 days before they take effect. If you don’t agree, you can stop using Kolbaba and have your account deleted before then. Changes that only add features or that the law requires may take effect sooner. If you keep using Kolbaba after the changes take effect, the new Terms apply.
14. Governing law and disputes
- These Terms are governed by Czech law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
- If something goes wrong, write to us first; most things are easier to sort out directly.
- If you are a consumer, you can also turn to the Czech Trade Inspection Authority (Česká obchodní inspekce) for out-of-court resolution of consumer disputes: coi.gov.cz.
- If any part of these Terms is invalid, the rest stays in force.
- These Terms are available in English and Czech with the same meaning. If the two ever differ, the Czech version prevails.
